Terms of Service

These terms apply to services provided by Ryder Ferguson trading as Highmark Media (ABN 56 220 080 322). By booking a shoot you agree to these terms.

Bookings

Bookings are confirmed once we have confirmed the date, time, address and package with you. The client is responsible for making sure the property is ready and accessible at the booked time.

Pricing and payment

• Prices are listed on this website in Australian dollars. [Confirm: prices include GST / do not include GST / GST not applicable.]
• Unless agreed otherwise in writing, 50% of the price is payable before the job starts and the remaining 50% on completion.
• [How payment is made, e.g. bank transfer, and when the completion invoice is due.]

Rescheduling and cancellations

• [Notice required to reschedule or cancel without a fee, e.g. 24 hours.]
• [Fee for late cancellation, or if the property is not ready or accessible on arrival.]
• [Weather policy, e.g. if weather makes a shoot unsafe or unsuitable, particularly for drone or exteriors, we will agree a new time at no extra cost.]

Drone

Drone work is carried out in line with Civil Aviation Safety Authority (CASA) rules. Some locations, such as areas near airports or restricted airspace, may limit or prevent aerial shots. Drone flights also depend on wind and weather on the day. [Confirm your CASA licence or operating category.]

Delivery

Turnaround times on this website are in business days and are estimates. Photos in every package are sent over in a timely manner. We will let you know straight away if anything will delay delivery.

Copyright and licence

• We own the copyright in all photos, video and other content we create.
• For real estate work, the client receives a licence to use the content to market the property for sale or lease, including on property portals, the agency website, social media and print. [Confirm whether the licence lasts for the campaign only or indefinitely, and whether the vendor may use the content.]
• For commercial work, the licence is set out in the quote.
• Content may not be resold or supplied to third parties, such as builders, stagers or other agents, without our permission.
• We may use the content in our own portfolio and marketing, unless we agree otherwise in writing.

Revisions

[What edits are included, e.g. one round of reasonable video revisions, and the rate for additional changes.]

Your rights under Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any rights you have under the Australian Consumer Law that cannot lawfully be excluded. Subject to that, our liability is limited to re-supplying the services or paying the cost of having them supplied again.

Governing law

These terms are governed by the laws of Queensland, Australia.
